Purchasing a Solid Waste Truck

The Town would like to purchase a dump truck, and would like to consider purchasing from Iron Planet On-line auction. If Town were to before the auction research competitive prices to a like dump truck (time permitting to get responses), Town would know if the auction was a good price. Transport would also need to be considered. The Town’s procurement policy is set at $5,000 requiring three bids. The Town will not purchase a truck over $75,000, although no requirement for formal bid on used equipment. The only inspection would be done by Iron Planet. Any thoughts?

    I believe you are required to go out to bid, but would love to know if you learn otherwise.

    (t) If a city, town or joint powers board is unsuccessful in acquiring a bid as provided by this section, the city, town or joint powers board may proceed to acquire a vehicle or equipment for which the bid was sought through a solicitation process, provided that the cost of vehicle or equipment to be obtained under this subsection shall not exceed two hundred fifty thousand dollars ($250,000.00).

    With your procurement policy limiting you to $5,000.00, that is more stringent than the new statute language, it would appear that you are bound by your own policy for now. We have purchased used equipment through WYDOT & online auctions before with success, but we’re always under the state statute threshold and within our budgetary constraints locally. We recently purchased a used tractor from the school district in Hot Springs County and had to wire the money, which I did not like, but that was part of the site’s requirements over a certain amount bid. We had the option for credit card payment under $4,000 and anything over was required to be paid by wire transfer. Just know the details of the payment and pick-up arrangements before you bid.

    Also, check in with the DEQ to see if they have a granting program for the purchase of solid waste equipment!

    Good Morning,
    Since you are only looking for used the bidding requirements are not required until you reach a value of $75,000. All new vehicles are required to be bid. There are some new statues if you bid and don’t receive any that can help out. Since the towns purchasing policy is to require 3 bids (I guessing this is a quote not a formal bid). This is an administrative policy for the town. I would work with the level governance that put the policy in place to get a single/temporary change or exemption to the policy and document it. If it is passed by the Governing Body I would think it would be prudent to asking the Governing Body for a temporary exemption of the quote process for this one purchase and document it. If management approved it then I think that level of approval would be prudent. The overall key I think is to document the deviation from the policy, who approved it and why it is needed.
